The Supreme Court

The Supreme Court is the highest court of the United States, and the only

one specifically created by the Constitution. A decision of the Supreme

Court cannot be appealed to any other court. Congress has the power to fix

the number of judges sitting on the Court and, within limits, decide what

kind of cases it may hear, but it cannot change the powers given to the

Supreme Court by the Constitution itself.

The Constitution is silent on the qualifications for judges. There is no

requirement that judges be lawyers, although, in fact, all federal judges

and Supreme Court justices have been members of the bar.

Since the creation of the Supreme Court almost 200 years ago, there have

been slightly more than 100 justices. The original Court consisted of a

chief justice and five associate justices. For the next 80 years, the

number of justices varied until, in 1869, the complement was fixed at one

chief justice and eight associates. The chief justice is the executive

officer of the Court but, in deciding cases, has only one vote, as do the

associate justices.

The Supreme Court has original jurisdiction in only two kinds of cases:

those involving foreign dignitaries and those in which a state is a party.

All other cases reach the Court on appeal from lower courts.

Of the several thousand cases filed annually, the Court usually hears only

about 150. Most of the cases involve interpretation of the law or of the

intent of Congress in passing a piece of legislation^ A significant amount

of the work of the Supreme Court, however» consists of determining whether

legislation or executive acts conform to the Constitution. This power of

judicial review is not specifically provided for by the 'Constitution,

.Rather, it is doctrine inferred by the Court from its reading of the

Constitution, and forcefully stated in the landmark Marbury Madison case of

1803. In its decision in that case, the Court held that "a legislative act

contrary to the Constitution is not law", and further observed that "it is

emphatically the province and duty of the judicial department to say what

the law is". The doctrine has also been extended to cover the activities of

state and local governments.

Decisions of the Court need not be unanimous; a simple majority prevails,

provided at least six justices — the legal quorum — participate in the

decision. In split decisions, the Court usually issues a majority and a

minority — or dissenting-opinion, both of which may form the basis for

future decisions by the Court. Often justices will write separate

concurring opinions when they agree with a decision, but for reasons other

than those cited by the majority.

Delia finished her cry. She stood by the window and looked out dully at .

a grey cat walking on a grey fence in a grey yard. Tomorrow would be

Christmas Day, and she had only one dollar and eighty-seven cents with

which to buy Jim a present. She had been saving every penny she could for

months, with this result. Twenty dollars a week doesn't go far. Expenses

had been greater than she had calculated. They always are. Only one dollar

and j eighty-seven cents to buy ft present for Jim. Her Jim. Many a happy

hour she had spent planning for something nice for him. Something fine and

rare — something just a little bit worthy of the honour of being owned by

Jim.

Suddenly she went away from the window to the mirror which hung between

the windows. Her eyes were shining brilliantly; but her face had lost its

colour within twenty seconds. Quickly she pulled down her hair and 'j let

it fall to its full length.

Now I must tell you that the James Dillingham Young had two possessions in

which they both took a mighty pride. One was Jim's gold watch that had been

his father's and his grandfather's, The other was Delia's hair.

So now Delia's beautiful hair fell about her like a cascade of brown

waters. It reached below her knee and Wade itself almost a coat for her.

And then she did it up again nervously and quickly. For a minute she stood

still while a tear or two fell on the worn red carpet.

She put on her old brown jacket, and she put on her old brown hat, and

with the brilliant sparkle still in her eyes, she hurried out of the door

New Economy

In Germany, the immigration debate moves into the spotlight over the issue

of much-needed (foreign) high-tech workers.

A debate familiar to many Americans has finally gripped Germany. The

German debate mirrors the U.S. situation in several ways — including the

political conundrum it poses for both German Chancellor Gerhard Schroder

and Vice President Al Gore. With important elections coming up — at the

state level in Germany and the national level in America — the issue is

moving into the spotlight. Schroder opened a recent computer fair with a

big surprise for Ms audience: "Germany desperately needs people with

technology skills", he said. "So why not welcome Indian or Russian computer

wizards into the country?" Even his original plan — for 30,000 temporary

high-tech-worker visas — fell, far short of what is needed. Germany lacks

300,000 skilled workers, half of them in the information-technology (IT)

industry itself. And the shortfall is getting worse. Still, under the

pressure from unions and fundamentalist conservatives, the chancellor soon

scaled back his proposal.

And with German unemployment at 10 percent, retraining the domestic work

force is a vital goal. But in an industry where a few months can make or

break a company, waiting two years or more for the first retrained workers

to appear is not a solution.

The suggested compromise — trying to attract 20,000 foreign IT workers to

Germany — won't do much for the high-tech companies Schroder is so keen to

help. And it certainly doesn't bode well for the European Union's recently

proclaimed goal of becoming "the most competitive and dynamic knowledge-

based economy in the world". To have a prayer of moving past the United

States in the IT area (which this goal implies), Europe cannot afford to be

so lukewarm to the immigration of highly skilled, non-EU foreigners.

The United States, of course, owes a good portion of its technological

prowess to newcomers. Indian and Chinese immigrants accounted for a third

of the technology start-ups in Silicon Valley between 1995 and 1998. For

the United States, which currently issues 115,000 Hl-B visas a year, the

question is one of raising the number, not starting a program, as it is in

Germany. Yet there, too, the issue is politically charged — and puts Gore

in a position much like Schroder's. Both men have repeatedly reached out to

the New Economy players, hoping to win political support at the expense of

the traditionally pro-business conservative parties. They've tried to

balance this with appeals to their traditional supporters in labour. But

the computer and software industries in both countries want more temporary

workers-while organized labour is determined to keep such workers out.

But for now, Chancellor Schroder and, Vice President Gore are twisting in

the same political winds. It's not easy reconciling the demands of Old

Economy and New Economy supporters. In the end, though, both may find that,

to keep an edge in a globalized economy, there is no alternative to opening

up to the world.
